By accessing and using Pulse Toronto's services, including our fitness sessions, urban cycling tours, and group outdoor challenges, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Pulse Toronto, located at 200 Front Street West, Toronto, ON M5V 3K2, Canada.

If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website.

2. Service Description

Pulse Toronto provides dynamic active recreation programs designed to promote healthy lifestyles through guided activities for all skill levels. Our services include:

  • Professional fitness sessions conducted outdoors and in various venues
  • Guided urban cycling tours throughout Toronto and surrounding areas
  • Group outdoor challenges and team-building activities
  • Corporate wellness programs and custom recreational activities

All programs are led by certified instructors and designed to accommodate participants of varying fitness levels and experience.

3. User Responsibilities and Eligibility

By participating in our programs, you represent that you are at least 18 years of age or have parental consent if under 18. You are responsible for:

  • Providing accurate and complete information during registration
  • Disclosing any medical conditions that may affect your participation
  • Following all safety instructions and guidelines provided by our instructors
  • Arriving punctually for scheduled activities and properly equipped
  • Treating other participants, staff, and equipment with respect

Participants must be physically capable of engaging in moderate to vigorous physical activity. We strongly recommend consulting with a healthcare provider before participating if you have any health concerns.

4. Health and Safety Waiver

Participation in physical activities involves inherent risks. By using our services, you acknowledge and assume all risks associated with physical exercise and outdoor activities, including but not limited to:

  • Risk of injury from physical exertion or equipment use
  • Weather-related risks during outdoor activities
  • Traffic and urban environment hazards during cycling tours
  • Risk of accident or injury during group challenges

You hereby release Pulse Toronto, its employees, instructors, and affiliates from any liability for injuries or damages that may occur during participation in our programs, except in cases of gross negligence or willful misconduct.

5. Registration and Payment Terms

Registration for programs may be completed online, by phone, or in person. Payment is required at the time of registration unless other arrangements have been made. Our payment and cancellation policies include:

  • Full payment is due upon registration for all programs
  • Cancellations made 48 hours before the program start date are eligible for full refund
  • Cancellations made within 48 hours may receive credit for future programs
  • No-shows are not eligible for refunds or credits
  • Program changes due to weather or unforeseen circumstances will be rescheduled or refunded

6. Intellectual Property

All content on our website, including text, graphics, logos, images, and program materials, is the property of Pulse Toronto and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or use our content without express written permission.

During programs, we may take photographs or videos for promotional purposes. By participating, you consent to the use of your likeness in our marketing materials unless you specifically opt out in writing.

7. Code of Conduct

We maintain a positive, inclusive environment for all participants. Behavior that is discriminatory, harassing, dangerous, or disruptive will not be tolerated. We reserve the right to remove participants who violate our code of conduct without refund.

Participants are expected to follow all applicable laws and regulations, including traffic laws during cycling activities and park regulations during outdoor programs.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms of Service. We collect only necessary information for program administration and safety purposes.

We do not sell or share your personal information with third parties except as required by law or as necessary to provide our services.

9. Limitation of Liability

To the maximum extent permitted by law, Pulse Toronto's liability is limited to the amount you paid for the specific program or service. We are not liable for indirect, incidental, special, or consequential damages arising from your use of our services.

This limitation applies regardless of whether the claim is based on contract, tort, negligence, or any other legal theory, even if we have been advised of the possibility of such damages.

10. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services will be resolved through binding arbitration in Toronto, Ontario, or in the courts of Ontario if arbitration is not available.

Both parties waive the right to trial by jury and the right to participate in class action lawsuits.
